"Madam President, Commissioner, the protection of EU Member States’ cross-border investments has become an extremely complex and delicate issue following the adoption of the Treaty of Lisbon. More than 1 200 bilateral investment agreements concluded by Member States under different, frequently incompatible, legal regimes need to be placed comprehensively under the auspices of the European Union without impairing the rights of the parties involved. The only possible way out of the legal stagnation brought about by transferring Member States’ powers to the European Union would appear to be a principle allowing both sets of agreements to coexist over a transitional period, in order for Member States to renegotiate existing bilateral agreements or, in line with EU investment policy, to complete negotiations on agreements under preparation. Even so, proper cooperation between the Commission and Member States must be maintained throughout this process, so that there is absolutely no loss of legal certainty for investors and contracting parties."@en1
