Article 325 of the Treaty on the Functioning of the European Union imposes on the European Commission and the Member States the obligation of protecting the EU’s financial interest and fighting against fraud in areas in which the responsibility is shared between the European Union and the Member States. Pursuant to Article 325(5), the Commission, in cooperation with Member States, each year submits to the European Parliament and to the Council a report on the measures taken for the implementation of that article. The report from the Commission to the Council and the European Parliament on the Protection of the European Union’s financial interests – Fight against fraud – Annual report 2009 (COM(2010)382) provides a summary of statistics on irregularities reported by the Member States in those areas where Member States implement the budget (agricultural policy, cohesion policy and pre-accession funds, i.e. around 80% of the budget) and for the collection of EU’s traditional own resources. It also gives an estimate of irregularities in the field of expenditure managed directly by the Commission and an overview of the operational activities of the European Anti-Fraud Office."@en1
