When deciding on disputes, national courts are not making use of the possibility of requesting information or an opinion on a given case from the European Commission, nor are they making use of the right to turn to the European Court of Justice with a preliminary question, and nor is the Commission making use of the right to intervene as an
. Practice points to considerable problems with judicial application in this area, including major deviations from the settled case-law of the European courts. I have therefore called on the Commission to pay attention to the decisions of the national courts, and to take the measures necessary for achieving this objective. This call has been written into the Report on Competition Policy, and I have supported the final text of the report."@en1
