I am delighted with the adoption of this report, which should enable couples, from different Member States or residing in another country that is not their own, to choose the law that should apply to their divorce.
There were one million divorces granted in the EU during 2007, 13% of which involved couples consisting of partners of different nationalities. During these proceedings, European citizens were faced with legal problems affecting their separation.
I would point out that Portugal is taking part in the process of enhanced cooperation that would enable advances to made on this issue, blocked in the Council.
I would emphasise the need for this report not to result in a Member State being required to recognise as a marriage – even if solely for the purposes of its dissolution – a situation that is not considered as such by the legislation of that State, or which would be contrary to the principle of subsidiarity."@en1
