"− The need to establish a clear, comprehensive legal framework on the law applicable to divorce and legal separation arises out of an urgent need to address the problems that arise in the case of ‘international’ divorces. Until now, the disparities in national rules have not favoured the safeguarding of equal opportunities between spouses and neither have they protected the best interests of the children involved. On the contrary, they have helped to encourage the so-called ‘rush to court’. As the European Parliament Mediator for children contested by parents of different nationalities and based on experience gained during the work I have carried out, I support this proposal for a regulation to create legal certainty for the couples concerned and guarantee predictability and flexibility. One of the innovative ideas contained in the text of the regulation is the possibility of consulting a family mediator before, during and after the divorce proceedings. This is not only because this individual is of great help in informing the couple about the various forms and conditions of divorce and resolving any differences between them, but also because it protects the rights of children involved, helping them to make appropriate and amicable choices to protect the welfare of their offspring."@en1
