"Protection against counterfeiting and the protection of intellectual property are undoubtedly an important element on an international scale. However, no clear significance emerges from the proposed ACTA agreement in terms of high quality and especially balanced protection of the interests of all EU Member State citizens. This agreement, which has taken a long time to draw up, has lacked transparency at various levels in the preparatory stages, and is geared in its context more to the interests of one group. Although the agreement also declares, among other things, a strengthening of the monitoring by relevant bodies of goods in transit and the export regime or ex officio negotiations, a question arises here as to scope and other possibilities for enforcing the agreement, as its effect seems debatable without the agreed ratification by a large number of important countries worldwide. In relation to actually ensuring the protection of intellectual property, it can be said that on a global scale there is now a whole range of recognised, functioning and sufficiently proven instruments, institutions and contractual arrangements which currently ensure protection against counterfeits. At the same time, the assurance that it is not necessary to change the would, for a document of such importance and such a character, merit the submission of a more thorough legal analysis."@en1
