"Mr President, Commissioners, I would like to come back to the anti-counterfeiting agreement which is currently being negotiated, in particular, with the United States. This agreement raises some questions also for the United States, particularly among the officials from the US Patents Office. Furthermore, 75 US law professors have recently sent a letter to President Obama. They consider that the Anti-Counterfeiting Trade Agreement (ACTA), which is a simple executive agreement, would be contrary to the US constitution. While the European Parliament, as you know, is about to adopt a resolution on the ACTA Agreement, and this is still causing considerable disquiet and is far from finding unanimous support among our fellow citizens, I think that it would be useful for us to have a very clear response from the US negotiators on two points. Can ACTA be ratified by the United States? In their opinion, is ACTA a binding or a voluntary agreement? Indeed, an anti-counterfeiting agreement that does not include China, India and Brazil, and which would not be implemented by the United States, would be seriously lacking in credibility.
