"Madam President, ladies and gentlemen, the purpose of this agreement is to strengthen cooperation between the governments of the countries concerned in order to speed up the process for readmitting persons residing without authorisation, and to do so by clearly setting out all the necessary technical provisions: readmission applications, means of evidence, time limits, transfer modalities and modes of transport.
I voted in favour because I am convinced that this agreement is necessary as a fundamental tool in the fight against illegal immigration in the European Union.
The agreement contains a clause of non-affection in respect of other international law and data protection rules: the States have to comply with relevant obligations arising from international law, such as the principle of non-refoulement, and they will be held liable for expulsions before their national courts.
The principle of non-refoulement also has procedural implications, since States are required to conduct an assessment of the risk of ill-treatment, including in cases of indirect removal to an intermediary country.
The Agreement also establishes – and I shall finish here – a Joint Readmission Committee, and I would like to emphasise at this point, Madam President, that the European Parliament will unfortunately not be part of it. I therefore call on the European Commission to duly report back to us on its activities at regular intervals."@en1
