"Mr President, I will try to answer the question. Where Member States act in the scope of Union law, they must respect fundamental rights as enshrined in the Charter and in the general principles of Union law. Any violation of this obligation may lead to an infringement procedure before the European Court of Justice under Article 258 of the Treaty on the Functioning of the European Union. However, this is the only procedural means that the European Union has at its disposal to ensure the compliance of a Member State with fundamental rights. Conversely, where Member States act outside the scope of Union law, there is no general competence under the treaties in the area of fundamental rights. Therefore, the Union is precluded not only from monitoring in general whether a Member State respects fundamental rights, but also from monitoring whether a Member State complies with the judgment of the European Court of Human Rights."@en1
