"The entry into force of the Treaty of Lisbon requires clarification of some of its norms, particularly those with legal and procedural content, such as those addressing the legislative procedure, the hierarchy of norms and the powers of the institutions. Article 290(1) of the Treaty states that a legislative act may delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act. It does so with special reservations and severely restricts the scope of such acts. Nevertheless, this detailing of the law set out in the Treaty is important to prevent excessively disparate interpretations that would jeopardise the consistency of EU law. Although such acts are common in the Member States, that cannot be said of the acts in question. The legitimacy of the Commission and of the Member States’ governments is not the same, and therefore the delegation of legislation to the former requires greater care and attention, and it must be used sparingly. I agree that the use of legislative delegation should make it possible to adopt simple and accessible legislation, thus contributing to legal certainty, the efficacy of the delegate and control by the delegator."@en1
