"The proposal for a directive on the application of patients’ rights in cross-border healthcare attempts to create a consistent Community framework for offering certainty to patients in this area where, until now, the guidelines have been laid down by the European Court of Justice. Although the Court’s principles are fully applicable, certain ‘grey’ areas have now been clarified by the above-mentioned report. During the process of transposing into Community legislation judgments made by the European Court of Justice on the right of patients to receive medical assistance in another Member State, the proposal for a directive maintains the necessary balance regarding Member States’ responsibilities in this area. The directive’s provisions also aim to facilitate access to medical assistance services by calling for the need to create a direct reimbursement system between the funding body from the country of origin and the host hospital. Another interesting point in the report refers to the reciprocal recognition of medical prescriptions. The text only offers recommendations regarding the possibility of a pharmacy in the country of origin honouring a medical prescription issued by a doctor in another country, with it being up to Member States to decide which medicines will be available on a prescription basis."@en1
