"The delegation from the PvdA (Dutch Labour Party) supports this directive’s objective, namely to penalise the employment of illegal immigrants with a view to discouraging working illegally as one of the factors attracting illegal migrants, whilst at the same time aiming to prevent and control the exploitation of migrants. Despite a number of positive elements in this compromise, we felt compelled to vote against it for a number of reasons. Initially, there was liability covering the entire chain right up to the main contractor. Unfortunately, this clause did not make it into the compromise between the Council and Parliament, which is now restricted to the first stage in outsourcing or subcontracting. This is counterproductive and encourages more outsourcing in order to avoid social liability. Furthermore, there are insufficient guarantees that migrants will be protected and employers punished for breaking the rules. Migrants will not be entitled to receive any outstanding wages before they are deported, nor will they be allowed to wait for their pay in the European Union. The chances of them getting their money after they have been deported are non-existent. This means that illegal immigrants who become the victims of exploitation and want to fight for their rights hardly stand any chance at all."@en1
