"− In spite of the fact that gender equality is a fundamental right, gender inequality on the labour market, in terms of salaries, employment rates and quality of employment, remains a serious structural problem. Unfortunately, we see that a higher level of education does not always lead to smaller differences between the salaries of male and female workers. Mrs Madurell’s report reveals the Member States’ shortcomings in terms of the transposition and implementation of Directive 2002/73/EC on the implementation of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion, and working conditions. Above all, the rapporteur stresses that many Member States have not correctly transposed the definition of discrimination into their legal systems. In many countries, the only binding definition is a general one, which does not mention gender discrimination. In other countries, no reference is made to sexual harassment, or it is only included in a general definition of harassment (in Poland, sexual harassment is defined in Section 6, Article 183a of the Labour Code), which makes it much more difficult for injured parties to pursue their rights. Grassroots initiatives, which aim to raise awareness in society, as well as those which aim to help victims of discrimination, are extremely important in the fight against discrimination."@en1
