"I, like the European left, support full recognition of the fundamental rights of the workers. I refused to vote for the Andersson report because, individual positive elements notwithstanding, it still falls short. I feel that this report is a lost opportunity to effectively address the question of workers’ rights under primary European law. The exercising of fundamental rights, as acknowledged by the Member States, in the ILO conventions and in the European Social Charter, including the right of negotiation, cannot depend on the uncontrolled discretion of the judge and always come second, because it is based on a legislative source lower down the hierarchy. The right of trade union action must not be jeopardised. A 'social protection clause' needs to be included in the Treaties."@en1
