"The Andersson report is a useful contribution to this controversial and highly legally complex debate. In particular, its recommendation that EU countries should properly enforce the Posted Workers Directive, and the demand that the Commission draft legislative proposals to deal with the legal loopholes thrown up by the judgments and prevent any conflicting interpretation of the law, are welcome. We have to ensure that the Posted Workers Directive does not allow social dumping and for collective agreements to be undermined by workers from other EU countries undercutting wages and working conditions in the host country. We should not blame the Court, which merely clarifies what the law says – after all, the court has also given numerous favourable judgments from a social perspective – rather, we should focus our attention on rectifying the underlying legal situation. The Commission itself stated in April this year that the fundamental right to strike and to join a trade union does not override the right to provide services. It is vital that this report does not mark the end of the debate. If necessary, we should use our powers to veto the new Commission if they do not include the necessary legislative proposals in their first work programme."@en1
