"The proposed directive opens the way to imposing unified EU criminal law on the Member States. It uses environmental protection and workers’ concerns about environmental problems to promote the adoption of common EU criminal law. It even revokes the rule of the Member States’ unanimity that has applied to criminal matters until now. This paves the way to giving the EU the right and power to institute and impose criminal penalties wherever it deems this necessary. In the final analysis, certain provisions of the European Constitution are being reinstated. From now on their application comes under the new name ‘Treaty of Lisbon’ before it has even been ratified or entered into force. This is a dangerous development at the expense of the peoples of Europe. Investing the EU with the power to adopt unified criminal law without the unanimous agreement of the Member States is tantamount to abolishing one of the fundamental sovereign rights of nations: to decide what actions constitute a criminal offence and to specify the type and level of penalties. The primacy of Community law is thus established over national legislation and even national constitutional provisions. The aim is to impose directly on the people of Europe the will of legally sanctioned European capital monopoly. At the same time, the personal rights and democratic freedoms of peoples will be drastically reduced."@en1
