"The wording cited by Mrs Goudin is good, and it is fantastic that we want to protect and improve the environment, that is good wording in the Lisbon Treaty. The constant problem with the EU’s environmental policy is when environmental measures conflict with the internal market. Recently Commissioner Verheugen stated that in the past five years the Commission has taken Member States to the European Court of Justice a whole 19 times in cases where Member States have legislated to protect the environment. In all 19 cases the court ruled in favour of the internal market and against the environment. I am wondering whether this in any way strengthens the environmental guarantee? With this wording, can we say that the environment takes precedence over the demands of the market? Could you issue a statement on this please?"@en1
