"The report by Mrs Bárbara Dührkop Dührkop on cross-border cooperation in combating terrorism and cross-border crime () is very important for two reasons: firstly because it is necessary to combat effectively the above-mentioned phenomena, and secondly because of the issue of protection of civil rights and liberties. Consequently, these issues should be handled in a very sensitive manner. We need to reconsider Amendment 3 to the draft Council decision, which states that special categories of data concerning racial or ethnic origin, political opinion, religious or philosophical belief, party or trade union membership, sexual orientation or health should be processed only if absolutely necessary and in proportion to the purpose of the specific case and in compliance with specific safeguards. I see this as potentially seriously flawed. Who will decide what is necessary and in proportion and how will they reach that decision? Will it be some kind of ‘Big Brother’? Or an anonymous police officer for whom protection of human rights may be a very minor issue? How is health or sexual orientation relevant to combating terrorism? These are some of the reasons why I recommend that we reject the draft resolution as it stands: we need a much more precise text as a foundation."@en1
