The Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade was approved in September 1998 and entered into force on 24 February 2004. Regulation (EC) No 304/2003 concerning the export and import of dangerous chemicals implements the Rotterdam Convention. The Commission considered it necessary to bring an action against the Council and the European Parliament at the Court of Justice because it did not agree with the change in the legal basis (environment rather than common commercial policy). In its Judgment of 10 January 2006, the Court of Justice annulled the Regulation on the grounds that there should have been a dual legal basis including both Article 133 and Article 175(1) of the Treaty, and ruled that the effects of the Regulation would be maintained until a new regulation founded on appropriate legal bases was adopted. The European Commission submitted a new draft regulation based on the above-mentioned dual legal basis. In today's vote, at first reading, the European Parliament approved a range of amendments to the European Commission proposal that will now be negotiated with the Council. Hence our vote in favour."@en1
