"The Commission uses all the instruments available to ensure the effective enforcement of consumer rights across Europe. A new consumer-enforcement network was established at the end of 2006 in the regulation on consumer protection cooperation. It provides a framework for joint market surveillance and enforcement exercises, such as the sweep on air ticket sales sites, carried out in September 2007. That was the first ever exercise of its type. The Commission coordinated this exercise, and provided the results of the first phase of the investigation in November 2007. At this stage, the disclosure of the names of the sites on which certain irregularities were detected, as suggested by the honourable Member, would be premature and would not respect the legal framework in certain Member States. I quite understand your impatience, because we would all like to get things done, and in the right way. However, the right of reply, which means the right to defend oneself, is recognised across the EU Member States. It is the competence of the national authorities and courts to apply that right, and we are awaiting the outcome of court decisions in some countries. The Commission will, therefore, present the outcome of the investigations and enforcement actions presently ongoing in the Member States once those proceedings have been completed. I have held talks with the authorities on the basis of the consumer enforcement network, and they are committed to going further and to providing this data, but court procedures – in at least two countries – prevent us from having a full picture and from announcing it publicly."@en1
