We Swedish Social Democrats voted for the report since it is important to remove the current obstacles to the collection of maintenance contributions from a citizen with residence in a Member State other than that of the person entitled to maintenance. In this connection it is particularly important to protect the weaker party in the collection procedure. However, we are opposed to the wording of Amendments 9 and 26 which require the parties, after independent legal advice, to enter into a written agreement on the jurisdiction of the court and on the national law which should be applied in order that the agreement should be effective in the court. Such requirements are not compatible with the Swedish legal tradition."@en1
