"Madam President, I would also like to express my disagreement with limiting legal protection of industrial design for spare parts. We are witnessing an unprecedented level of interference in the area of industrial rights. If there are abuses of monopolies by industrial rights owners, ordinary legal instruments such as licence requirements can be applied. The creation of an industrial design incurs significant costs, which is why legal protection is pertinent from an economic point of view, too. Its abolition will not lead to liberalisation of the spare parts market as expected by the Commission, but in all likelihood to an increase in the price of the end product. The foreseeable reaction of producers to the presence of independent producers in the spare parts market will be to offset their losses through higher prices. It is also of concern that the lower cost of independent producers’ spare parts will result in lower levels of safety and quality. What troubles me is that in the final analyses it will be the customer who will be placed at risk."@en1
