"Madam President, as the basis for cooperation within the EU the Member States have signed several treaties laying down the basic rules governing what the EU is and what the EU must do. This is called primary law and the EU institutions are not permitted to take decisions which are not based on primary law. I wish to draw the Chamber’s attention to the resolution by the rapporteur Manuel Medina Ortega in which he urges the Commission to avoid the expression of soft law. As we all know, soft law is non-legally binding documents presented by the Commission to clarify directives in different policy areas. It is fortunate, not regrettable as Mr Ortega puts it, that the Member States have voting powers in areas where full harmonisation of the law is merely an impossible dream of the federalists. Community law is binding only in areas where the Member States themselves have delegated decision-making rights to the Community."@en1
