I voted in favour of the report by my fellow Member, Mrs Wallis, on the draft regulation of the European Parliament and of the Council on the law applicable to non-contractual obligations (ROME II). This extremely complex matter is a step in the direction of harmonising the Member States’ conflict of law rules applicable to non-contractual obligations, that is to say, the consequences of road traffic accidents, unfair competition, environmental damage, defamation and, more generally, violation of personal rights, etc. Overall, the European Parliament has not been sufficiently heard by the Member States, and the countless studies and reports that are to weigh up the consequences of this agreement will be crucial when we return to this important matter. For example, regarding road traffic accidents, how can we be content with applying the law of the country of the accident, and not that of the country of residence of the victim, and are we sure that recitals of this regulation on their own will make it compulsory for the courts to assess losses? How are we going to manage defamation in the context of a globalised and dematerialised press? The examples go on. A considerable amount of work awaits us on these issues."@en1
