"Madam President, I should like to refer specifically to the Sterckx report. I would like to address two of the rapporteur’s amendments dealing with restrictions on data access. Although I can sympathise with the intention of the rapporteur in seeking to reduce the risk of commercial misuse of data, I feel that the unintended consequences which will result will outweigh the advantages. Given the fact that action has already been taken outside of the EU on this issue, this raises serious questions as to why we feel it is necessary to legislate here. I refer to action by Lloyd’s Register in London and its Dutch counterpart to set up a self-regulatory scheme. These discussions have resulted in AIS restructuring, in order to specifically alleviate the concerns raised and benefit legitimate industry as well as government users. Subsequently, all parties who use this AIS data have agreed to use these measures. My fear is that if the proposals on restricting access to this data are adopted, European ports and companies will be put at a commercial disadvantage. This is due to overseas competititors being able to continue to be supplied with services which make use of the AIS data. Also, as the information which may lead to commercial misuse can easily be obtained from other sources in more detail, why are we only choosing this specific data system? Finally, these clauses would be unenforceable. AIS data is transmitted using normal high-frequency signals and there are a number of receiving devices on the market which are completely untraceable, meaning that anyone who wishes to misuse the data can still do so. Therefore, I call on the House to think carefully about the content of this report and not to fall into the trap of over-regulation at a time when we are calling for less regulation from the Commission."@en1
