"Mr President, I wish to thank the Commission for its communication on the consequences of the judgment of the Court on criminal sanctions and I agree with the conclusions it makes. Indeed, I believe that the interpretation of this judgment should not apply solely to the environment, and this so as to strengthen Parliament's democratic control and to thus enable Europeans to be better protected. The Court judgment has made it possible to clarify the powers in relation to criminal provisions between the first and the third pillar. It therefore stipulates that the aim and content of the act itself be taken into account in order to establish the need for criminal sanctions to be laid down. That allows us to conclude that the protection of fundamental rights is an area to which the consequences of this judgment can be extended. Special attention should be paid to fundamental rights and to the protection of the Union's interests when resorting to criminal sanctions. I do not believe, however, that we had to limit ourselves to resorting to these two areas alone, and Amendment 16, which I tabled with my colleague, Mrs Berger, is along these lines. That is why I call on you to support it. Finally, this judgment is a new signal calling on us to provide for, by means of Article 42, and as you have said, the communitisation of all aspects of police and judicial cooperation in criminal matters. I will say it this evening: this would make it possible to ensure greater legal certainty and, above all, more coherent criminal measures."@en1
