As you will be aware, and as I said a few minutes ago, the Laval case is currently pending before the European Court of Justice, and the Commission services are at present preparing the Commission’s comments. In principle, these latter should not call any Member State’s social model per se into question They should, however, unfailingly uphold the principle that the economic freedoms enshrined in the Treaty can be combined with the various social models. As previous speakers have already noted, there need be no contradiction between the two goals of supporting fair economic competition and guaranteeing protection for workers. It is self-evident that any social model that is implemented must comply fully with the goals and fundamental principles of Community legislation and that it must observe these latter, in particular when it comes to such principles as legitimacy of aim, objective justification and proportionality. Ladies and gentlemen, the Commission is in the process of preparing an opinion that will form part of proceedings before the European Court of Justice.
