Madam President, the regulation cited by Mrs McAvan in fact lays down common rules for compensating and assisting passengers in the event that they are denied boarding, their flight is cancelled or they face a long delay. Since the regulation entered into force on 17 February 2005, the Commission has been watching closely to ensure that it is being enforced by the Member States and has been monitoring the airlines to check that they are enforcing it. In order to ensure that the regulation is being enforced uniformly in all parts of Europe, the European Commission has started infringement procedures against several Member States that have not yet taken the necessary steps to set the penalties to be imposed on airlines if they do not comply with the legislation in force. Furthermore, on the basis of the complaints that it regularly receives, the Commission has noticed certain practical difficulties in effectively implementing the regulation and in monitoring its enforcement by the Member States. This is particularly the case as regards the obligation placed on the national bodies to take the necessary steps to safeguard passengers’ rights and to investigate the complaints lodged. In this context, the Commission is currently working with the national authorities in order to arrive at a harmonised interpretation of the role that these bodies have to fulfil in terms of monitoring, and dealing with, complaints."@en1
