There is long-established European Court of Justice jurisprudence in this area. The situation is as I outlined previously in response to a question regarding another insurance undertaking in the United Kingdom.
The Commission is not in a position to pursue the matter in the way that the honourable Member and other Members of the House would like it to, because it is not the way the Commission can do things. The European Court of Justice only finds in relation to the way a directive has been transposed and the situation as it is at the present time. It is for policy-holders who have been affected by any change to pursue those issues through their own national courts.
