As I said, it would be possible first of all to provide for the communication to the airlines of persons included on the no-fly list, to be provided suitably in advance of the aircraft’s departure, precisely to avoid cases such as those that have occurred of errors being discovered when the aeroplane is already in flight, with route diversions as a result.
Then there is the possibility of achieving a substantive dialogue on the criteria for inclusion on the no-fly list, to which there would obviously be restrictions connected with the national sovereignty of the United States, which to date has not agreed to make these factors known precisely. We are talking exclusively about overflying the territory of the United States, not about flights from and to the United States."@en1
