"If there is one field in which the rules must be clear and certain, it is the legal field in relation to contractual obligations. And that is the great merit of Mrs Wallis’ report, which helps to improve legal certainty in this area. Rather than seek an artificial unification of all rules of law, she achieves unification by proposing a harmonisation of the rules governing the conflict of laws and jurisdiction – which is the correct approach – in order to determine which law is to apply, and this makes it possible to combine the package of national rules with the demands of legal certainty. With regard to the damage to personal reputation or private life due to attacks by the media, it should be emphasised that obtaining compensation has become extremely difficult. The necessary right of reply, in particular, tends to be substantively violated due to the procedural difficulties with which it has to contend, all in the name of an abusive interpretation of press freedom. In this context, the proposed solutions are reasonable but must not restrict the rights of the persons subject to attack. We shall vote in favour of this report."@en1
