As far as the freedom to provide services is concerned, the Commission has been made aware of problems encountered by companies from the new Member States who post their workers to the Netherlands. A number of complaints have been received. The Commission is presently looking into the matter to ensure that the freedom to provide services as provided for under Article 49 of the Treaty is respected and any unjustified obstacles are removed.
The Commission is not aware of instances in which Polish firms operating in Italy, Germany or other Member States may have been discriminated against. No such complaints have been lodged with the Commission. However, the Commission is in the process of writing to the relevant Member States to request further information to establish whether breaches of EU rules may have taken place. In light of the information provided, the Commission will assess the situation in each Member State and decide upon the appropriate steps."@en1
