"The Moderate delegation has today voted in favour of the report on the Treaty establishing a Constitution for Europe,. We believe that the Constitutional Treaty should respect the institutional balance. We therefore reject the proposals to introduce an elected President of the Council and to have the President of the Commission elected by the European Parliament. We are also opposed to the procedure laid down in Article IV-444 and generally known as the passerelle, because we consider it fundamental that changes to the Treaty be ratified by each Member State before they enter into force. The Constitutional Treaty makes the basic rules governing cooperation in the European Union easier to understand. We are in favour of the greater weight given to subsidiarity, and we support the wordings that re-confirm and further develop the national parliaments’ role in European cooperation. EU law, as it has been in force and been applied, is affirmed when it comes to the relationship between EU law and national law; that is to say, Community law takes precedence over national law, account always being taken however of the Member States’ constitutional traditions. The limits of the EU’s competence are also clarified, and the legislative procedure simplified. We therefore support the proposed Constitutional Treaty."@en1
