"Mr President, in accordance with Rule 168(2) of the Rules of Procedure, I would ask, on my group’s behalf, for the vote to be postponed and the matter referred back to committee. The reason for this lies in Rule 35 of the Rules of Procedure, which concerns verification of the legal basis. Article 18.3 of the Treaty specifically exempts passports and residence permits from the EU’s areas of competence. The proposed legal basis in Article 62 refers to standards and procedures Member States carry out checks, but not to competence in respect of passports. I request a referral back to committee so that the Committee on Legal Affairs is given the opportunity to express its opinion on the legal basis for both this report and the report on residence permits that will be debated during the next part-session. We also demand an addition to the legal service’s opinion, since they themselves admit in paragraph 50 that they do not have sufficient competence to judge whether all the measures come within the framework for the legal basis. What is more, the American Court of Auditors has written a report that sheds light upon the costs and the problems associated with biometric data, so I also question the effectiveness of the measure as such and wonder whether the Council has sufficiently investigated these matters."@en1
