Mr President, as I have already said in reply to a number of questions from your House, the Council repeats that it is the responsibility of the individual Member State concerned to protect the rights and interests of citizens of the Member States overseas as provided for by the Treaty of Vienna on consular relations. Member States whose citizens are held in Guantanamo Bay or elsewhere are taking the steps they consider necessary in order to ensure that their citizens’ rights under their bilateral relations with the United States are respected. The Council is unable to provide details of these courses of action, questions concerning which should be addressed to the Member States in question. Speaking in general terms, I will point out, in response to this question, that the EU has always expressed its concern about the situation in Guantanamo Bay and has, on several occasions in its dealings with the United States, stated that the treatment of prisoners should conform to the standards laid down by the Geneva Convention and of human rights. As recently as July, there was an official discussion between the European Union and the United States, at which the United States highlighted the establishment of what it calls ‘combatant status review tribunals’ following recent rulings by the American Supreme Court. Representatives of the European Union set out the concerns that still exist on the European side, including those relating to the creation of a new category of prisoners, termed ‘hostile militants’. In conclusion, the Dutch Presidency will, in its dealings with the United States, continue to raise the concerns that remain about the status of the prisoners in Guantanamo Bay and the treatment they receive."@en1
