Under the terms of Article 245(2) of the EC Treaty and Article 160(2) of the European Atomic Energy Community (EAEC) Treaty, the Court calls on the Council to add the following amendments to the Protocol on the Statute of the Court of Justice: under the terms of Article 17 of the Protocol, Decisions of the full Court shall be valid only if 11 Judges are sitting. With the increase in the number of judges – from 15 to 25 – following enlargement, it is proposed that this quorum should be set at 15. Pursuant to Article 16 of the Protocol, the Grand Chamber, which sits in particular when a Member State or an institution of the Communities that is party to the proceedings so requests, consists of 11 judges. It is proposed to increase the number of judges forming part of the Grand Chamber to 13, as well as maintaining the current quorum of nine judges. According to the rapporteur and the Committee on Legal Affairs and the Internal Market, the proposal on which the EP is consulted ‘appears to have obtained a consensus both in the Council and the Court and is well-founded, and can therefore be approved without amendment (explanatory statement)’. We see no reason not to endorse this conclusion and therefore voted in favour."@en1
