lpv:spoken text	". I confirm that it is extremely difficult, because almost half the Member States do not agree that there is a legal basis to deal with these issues at European Union level. That is not the position of the Commission. We think that mutual recognition, which is the cornerstone of judicial penal cooperation, requires mutual confidence among Member States. To a certain extent, to create that climate of mutual confidence, we need a minimum degree of harmonisation or at least approximation of penal law, including procedural guarantees. We are not working in an empty field; the European Convention on Human Rights lays down some standards. We think that we should go further at European level and be more specific about how to use the procedural guarantees already laid down in the European Convention on Human Rights. We will present our proposal fairly soon and we will try to get it through the Council. It will not be easy, but I am determined to follow that path."@en1
