"Mr President, I would like to supplement Mr Ortuondo’s question, and remind him that this is not a decision by the Spanish Government, but that it is the Spanish Constitution itself which prevents an autonomous community from holding a referendum unilaterally and requires that any referendum be called by the King, on the proposal of the President of the Government, following authorisation from the Congress of Deputies. That is what our Constitution says. I believe that the question Mr Ortuondo should have asked – although you probably would not answer it either – is whether a person failing to comply with a law can be subject to penalty, which is what the Spanish authority has said or, in this case, the reform of the Spanish Penal Code."@en1
