At the time of the review of the common fisheries policy in December 2002, the Council considered that the outermost regions deserved special treatment, specifically as regards the management of the Community fishing fleets. This Commission proposal comes in that context but falls short of what might be desired in view of the real difficulties of the regions in question, which have non-industrial fleets and small-scale companies, which have led to less than full take-up of the support available for fleet modernisation and renovation. It is therefore important to ensure that this process of modernisation and renovation can continue without constraints deriving from Community legislation. The rapporteur’s proposals improve the Commission proposal. First, they propose a more suitable legal basis, Article 299(2) of the Treaty establishing the European Community, which recognises the special constraints affecting the social and economic situation of the outermost regions. In addition, they derogate from the provision on public aid for fleet renewal for a further two years, until 31 December 2006. Lastly, the rapporteur also calls for a report to be produced evaluating the implementation of these measures, in order to examine whether they should be continued after 2006. It is regrettable, however, that the necessary strengthening of FIFG structural aid is not included."@en1
