"Question No 7 by Josu Ortuondo Larrea (): Article 9(1b) of Council Regulation (EC) 2369/2002 of 20 December 2002amending Regulation (EC) 2792/1999laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector states that public aid may be granted for the modernisation of fishing vessels only where such vessels do not exceed 400 GT. In addition, Article 1(3) of the same regulation states that the measures adopted 'shall not increase fishing effort'. Certain fishing fleets, in view of their particular characteristics and those of the surrounding zones (ocean-going vessels, freezer tuna vessels, etc.), cannot possibly operate in an even minimally profitable fashion using vessels under 400 GT. Nonetheless, the fisheries sectors concerned have expressed genuine interest in the modernisation of their old vessels, without asking for any corresponding increase in capacity. In view of the above, can the Council state whether, under Regulation (EC) 2369/2002, the possibility exists of granting public aid, up to the maximum corresponding to 400 GT vessels, for the modernisation of fishing vessels of larger size and tonnage, provided the remaining criteria under the regulation are met and the modernisation does not entail any increase in the fishing effort?"@en1
