Some people will undoubtedly say that Article 308 of the EC Treaty is not the appropriate legal basis, that this legal base excludes the EP, in other words that it is denied codecision in this area and, in future, will merely be consulted. The arguments put forward by a number of my colleagues in favour of rejecting the text for this reason are relevant and convincing. Article 95 of the EC Treaty on the approximation of national laws which have as their object the establishment and functioning of the internal market certainly seems to be the appropriate legal base. Yet is it wise to risk postponing indefinitely a statute that has already been awaited by the social economy for several years? I do not think so. I will therefore abstain on Amendment No 1, which disputes the legal base, with a view to ensuring that the text is adopted in due time."@en1
