"Mr President, ladies and gentlemen, the circumstances of this debate are certainly not the best for expressing one’s thoughts. On behalf of the Italian Radicals, we will continue to consistently oppose the bare idea of the creation of a European Public Prosecutor which is not accompanied by those instruments and those arrangements which form part of the legal and cultural heritage of our countries. How can we possibly consider just a European Public Prosecutor without the judgment, appeal and defence mechanisms which are inherent and peculiar to each country’s legal system? Rushing headlong in this way can only make the structure that we are trying to give Europe even more justicialist and export a certain model of Italian justice with which we are all familiar and which has caused a great deal of harm in our country. These are the reasons why we will be voting against the Theato report, having already voted against in committee, not because the idea
is without foundation, but because it lacks all the attributes to make it effectively fair, as justice also at European level should be."@en1
