". – It is my pleasure to be here, particularly when the discussion is so interesting and there are so many participants. The provisions of the recently adopted Directive 2002/73/EC define for the first time, in a binding Community text, harassment on the basis of sex and sexual harassment as discrimination in the work place and, therefore, prohibit them. Moreover, Member States have to take the necessary measures to encourage employers to prevent harassment and sexual harassment in the work place. These provisions concern the private and public sectors and include the armed forces. The new directive reinforces protection for victims of discrimination based on sex with specific provisions reflecting the case-law of the Court. In order to comply with the provisions of this directive, all Member States, including Spain of course, will have to take implementing measures and bring them into force by 5 October 2005 at the latest. By this date, these measures, including those on harassment and sexual harassment, should also cover the armed forces. Member States should guarantee by this date that all necessary measures have been taken to eliminate discrimination on the basis of sex in all matters covered by this directive."@en1
