"Mr President, ladies and gentlemen, the Napolitano report addresses one of the most controversial issues facing the Convention. It is an issue which puts to the test the principle of subsidiarity and the very ideal of Europe as a community of diversities, and it involves different national historical traditions and systems whose attitudes towards regional power vary. I believe it is right for the proposal on the Union’s powers not to interfere with the systems of the individual States. We cannot, however, disregard the fact that some national Constitutions confer major legislative powers on the regions, and the Convention will have to recognise this, although without creating privileges, without upsetting the internal market and without removing the need for a political Europe. For all these reasons, I feel it is right to give the regions with legislative powers the right to approach the Court of Justice directly when their prerogatives are affected by European measures. I believe that it would be a mistake to overlook the fact that some or regions – in Germany, Italy or Spain – are territorial authorities which are much larger than some of the entities established in the national States. Widespread consensus on this report, which Mr Napolitano has rightly called for – is necessary to the constitutional process, which must facilitate the participation of regional and local authorities in Europe’s future as a community."@en1
