The Council would remind Mr Ortuondo that Article 203 of the Treaty establishing the European Union lays down that “The Council shall consist of a representative of each Member State at ministerial level, authorised to commit the government of that Member State”. Apart from this provision, it falls to each Member State to decide the composition of its representation and, therefore, it falls to the Presidency to establish, in its capacity as such, how it will be represented in its appearances and parliamentary acts. This decision will inevitably depend partly on national constitutional provisions, which differ from one Member State to another.
