"Question No 2 by Carlos Carnero González (): According to media reports, Spain (which is to take over the Council Presidency on 1 January 2002) has proposed a comprehensive EU-USA pact on extradition. The author of this question takes the view that the essential cooperation between the EU and the USA in the fight against terrorism must be based scrupulously on observation of the basic principles and values of a constitutional state. For the EU Member States, these values include abolition of the death penalty. For this reason the author of this question – in line with the main human rights organisations – considers that any future agreement between the EU and the USA must observe the spirit and the letter of Article 19 of the Charter of Fundamental Rights, since the death penalty remains in force in the USA and, furthermore, military tribunals are to be set up. Does the Council undertake to regard Article 19(2) of the Charter of Fundamental rights as fully binding in any agreement with the USA on extradition?"@en1
