"The definition of terrorist offences is almost finalised. The element of initial intention has been clarified. Added to this are two elements that can also be characteristics of terrorist intent, namely severely intimidating the population or unduly forcing a State to carry out an act. At the same time, the types of conduct affected have been redefined so that only extremely serious offences are covered, in response to the concerns and criticisms that the initial definition was too broad. Two additional elements have been adopted by the Council in order to confirm the guarantees of respect for fundamental rights. First of all, the preamble will state that the framework decision is without prejudice to the exercising of human rights, in particular, the right of association, expression and demonstration. Also, a political declaration will add to these precautions, specifying that the decision does not cover people who are acting to preserve or restore democratic values, or people who are exercising the right to express their opinions, even if, while exercising that right, they commit offences. Finally, the preamble will exclude from the framework decision’s scope, the activities of the armed forces in a period of armed conflict when they are performing their official duties, as governed by international law. This is the situation with regard to the crime of terrorism itself."@en1
