Mr Krarup, the Commission is of the opinion that the Schengen rules are not the basis for either the Eurodac regulation or the future Community regulation that will replace the Dublin Convention. These are based not on the Schengen rules but directly on Article 63(4) of the EC Treaty. We are therefore undertaking a technical study into the possibility of implementing the Eurodac regulation and the future Dublin regulation, on the basis of a parallel agreement with Denmark, which will be in accordance with international public law. This agreement will not be based on the Schengen Agreement, but based directly on Title IV and on the possibility of implementing a parallel agreement under international public law."@en1
