"Mr President, I would ask permission to speak regarding the Rules of Procedure. The proposal for a directive which is being debated ought to be rejected pursuant to Rule 143 of the Rules of Procedure which specifies that, at the beginning of the debate on a specific item on the agenda, its inadmissibility may formally be moved. I am making such a proposal, and the reason why I think the proposal for a directive ought to be considered inadmissible is that it is, in my view, contrary to the Treaty. It is contrary to Article 152 of the Treaty, relating to public health, and there is no doubt that this proposal for a directive is entirely motivated by a concern to protect public health. Article 152 specifies that incentive measures may be taken, but excluding any harmonisation of the laws and regulations of the Member States. The proposal in question provides for a particularly intensive harmonisation of the laws and regulations of the Member States and is therefore contrary to Article 152. I searched the Commission’s proposal and Mrs Müller’s report in vain for a discussion of this question of where authority lies. I think the debate should be considered inadmissible until it has been clarified that the problem of authority is in order, and I would request that a vote be taken."@en1
