"I share your view that the question of having a strategy for encryption at European level is a key tool in enhancing security in the use of the Internet. But as you can imagine, in this new field we have to address the need to reinforce security on the basis of the subsidiarity principle, in the sense that we have to recognise that each Member State is entitled to adopt its own national legislation to guarantee law enforcement at national level. What we in the Commission do is to coordinate efforts at European level to guarantee law enforcement.
Our approach is to guarantee minimum common levels of law enforcement at European level, which does not prevent Member States introducing more stringent or national legislation. Nevertheless a comparison of national legislations would be an important factor when we adopt common rules at European level. I cannot give you a broad picture at the moment because in several Member States, such as the UK, legislation is still under preparation and has not yet been fully adopted by the national parliaments."@en1
